Summary:
The applicant is requesting approval of a special use permit for the ‘Recreation, Outdoor’ use with a preliminary site development plan for Nice Digs Volleyball to construct outdoor sand volleyball courts. The Unified Development Ordinance (UDO) requires special use permit approval for this use in the C-2 District per UDO 18.20.500.
The site is partially developed with an existing asphalt parking lot connected to the adjacent property which will be improved and used by this facility. The proposal includes five (5) volleyball courts which support up to 12 players at a time for a total of 60 participants. The proposed hours of operation are Sunday to Friday with potential Saturday tournaments from approximately 4:00 p.m. -11:00 p.m. The facility is expected to operate from April to October with no plans to operate in the winter months at this time.
The development provides 61 parking spaces, restrooms, two permanent accessory buildings for concessions, sitting areas, a shade structure, and 8-foot-tall perimeter fencing (black-coated chain-link & wrought iron) with masonry columns exceeding UDO requirements. In addition to the required landscaping, the applicant is providing additional shrubs and ornamental grasses along S. Flaming Rd and the southern fence line, exceeding UDO requirements. The applicant is amenable to all recommended stipulations and the initial five (5) year approval time period.
The Planning Commission held a public hearing on September 28, 2026, and no public comments were provided for this application. Staff received a question from the Planning Commission regarding the requirement of a Special Use Permit for the “Recreation, Outdoor” use. Staff stated that this recreation category includes several different types of sports courts, and the Special Use Permit process allows staff to evaluate the compatibility and nuances of individual development based on the scale, location, and surrounding area. There were no further questions or discussion.
The Planning Commission voted 7-0 to recommend approval of SU26-0013 as presented in the meeting minutes.
