Summary:
This is a request to accept the dedication of land for public easements for the final plat of Living Hope Church of the Nazarene, Third Plat (FP24-0031). The final plat establishes lot lines for two (2) lots and one (1) tract to accommodate a park and future commercial development. This replat is necessary to combine the existing Lot 1 to include the church’s proposed park and reestablish new boundaries for Lot 2 which will be subdivided as it develops into future commercial development, which is conceptual at this time.
New sanitary sewer (S/E), drainage (D/E), and utility (U/E) easements are being dedicated with this plat. All other easements are previously platted, and no new right-of-way will be dedicated with this plat. A 40-foot access and utility easement and 20-foot drainage easement were vacated with this plat. The unplatted area within Lot 1 is subject to a street excise tax of $0.215 per square foot of land and a traffic signal excise tax of $.0576 per square foot of commercial land. Lot 2 will be subject to excise fees with future development in accordance with the Excise Tax Payment Agreement dated October 14, 2011.

Action Needed:
1. Accept the dedication of land for public easements for the final plat of Living Hope Church of the Nazarene, Third Plat (FP24-0031) (majority vote of the Councilmembers present required).
2. Reject the dedication of land for public easements and return the plat to the Planning Commission for further consideration with a statement specifying the basis for the Governing Body’s failure to accept the dedication (majority vote of the Councilmembers present required).
