Summary:
Staff has negotiated a real estate contract (the “Contract”, included as Attachment A) to swap certain City-owned property located at the northwest corner of Lone Elm Road and College Boulevard (the “City Property”) with certain property immediately to the west of the City Property owned by Unified School District No. 233 (the “District Property”). The City Property consists of approximately 10.57 acres of land across 2 undeveloped tracts. The City Property lies adjacent to the District Property, which consists of approximately 9.74 acres of land across 3 tracts (where Meadow Lane Elementary School was constructed).
On October 13, the City Manager and District Superintendent signed the Contract so that the District could begin its due diligence activities on the City Property. The Resolution (Attachment B) ratifies the City Manager’s signing of the Contract in accordance with the City Council’s Surplus Real Property Policy (Policy F-10). The District Board of Education intends to ratify the Superintendent’s signature at its November 12, 2026 meeting.
The District’s closing on the City Property would take place on or before January 1, 2027. The contract has several contingencies precedent to the City closing on the District Property, including that the District completes construction of a new elementary school on the City Property, then clears, grades, and seeds the District Property. The District must also construct 110th Street in the previously dedicated road right of way between South Valley Road and South Noble Drive (the “110th Street Improvements”). The cost of the 110th Street Improvements will be split 50/50 between the City and the District. The 110th Street Improvements will be designed and constructed by USD 233 in accordance with applicable City standards and technical specifications.
The City would determine the future use of the District Property at a later date.
