Summary:
This item was provided as a report on the City Council agenda for the January 21, 2025 meeting. No changes were made to the proposed ordinance following that meeting.
The Risk Management Policy chapter of the Olathe Municipal Code addresses the City’s approach to risk management, including settlement of claims against the City. Currently, Section 3.60.140 provides authority to the City Manager to settle claims not handled by the City’s insurance carrier up to a maximum of $50,000. In 2024, the City Council amended the City’s procurement and surplus property policies to raise the City Manager’s authority from amounts under $50,000 to amounts under $100,000. Staff recommends the changes in the proposed ordinance (Attachment A) which make a corresponding increase to the City Manager’s authority for settling uninsured claims up to a maximum of $100,000. Proposed settlements in excess of $100,000 would be brought to the City Council for consideration in executive session.
