Summary:

The applicant is requesting approval of a rezoning from the C-2 (Commercial Center) District to the R-4 (Residential Medium-Density Multifamily) District with a preliminary site development plan for Stellar Apartments on approximately 15 acres south of 133rd Street and east of Blackfoot Drive.

 

The proposed development includes eight (8) vertically attached multifamily units and one (1) clubhouse building for a total of 280 residential units. An outdoor swimming pool, dog park, and walking trails with seating areas are provided as amenities for the residents. A previously approved preliminary site plan identified a strip retail center on this site, however no final plats or final site development plans have been approved for the property which has remained vacant since it was rezoned in 1988.

 

The proposal exceeds UDO requirements for architecture, open space and tree preservation, and aligns with several policies of the PlanOlathe Comprehensive Plan, Olathe 2040: Future Ready Strategic Plan, and meets the UDO Golden Criteria for considering rezonings as outlined the packet. The site is designated as Mixed Density Residential Neighborhood and Commercial Corridor on the PlanOlathe Future Land Use Map. The proposed multifamily residential development is consistent with and supported by both future land use designations.

 

On December 22, 2025, the Planning Commission held a public hearing for the proposed request with no individuals appearing to speak and no additional discussion was needed. The Planning Commission voted 8 to 0 to recommend approval of RZ25-0016 as stipulated by staff.

Action Needed:

1.                     Approve Ordinance No. 26-04 for a rezoning from the C-2 (Commercial Center) District to the R-4 (Residential Medium-Density Multifamily) District for Stellar Apartments as recommended by the Planning Commission (4 positive votes required).

2.                     Deny Ordinance No. 26-04  for a rezoning from the C-2 (Commercial Center) District to the R-4 (Residential Medium-Density Multifamily) District for Stellar Apartments (5 positive votes required).

3.                     Return the rezoning application to the Planning Commission for further consideration with a statement specifying the basis for the Governing Body’s failure to approve or disapprove (4 positive votes required).
