Consideration of Ordinance No. 26-56 levying special assessments on certain property to pay the cost of internal improvements in the City of Olathe, Kansas, as previously authorized by Resolution No. 26-1080 and providing for the collection of such special assessments.

Summary:
On October 20, 2026, the governing body adopted Resolution No. 26-1080 (attachment A), determining the advisability of constructing Brougham Drive, a City collector street generally located from 167th Street at the north to 171st Terrace at the south, approving the estimated or probable cost of the improvements, and establishing the extent of the improvement district to be assessed for the cost of the improvements. The improvements were authorized to be assessed equally per square foot against all property within the Improvement District and paid 100% by the owners within the district.
The Ordinance (Attachment B) authorizes the levy of special assessments against certain property within the Improvement District.
Stonebridge Land & Cattle, LLC and 175 Partners, LLC have signed a waiver of assessment proceedings and consent to the assessments (Attachment C).

Financial Information:
The estimated or probable cost of the proposed Improvements is $2,741,573.92, plus interest, bond issuance costs, reserves, and related financing costs.
