recommended motion:

1.                     I move to approve Ordinance No. 26-22 to vacate a portion of Alcan Street and 120th Street right-of-way in the vicinity of 119th Street and Alcan Street.

2.                     I move to deny Ordinance No. 26-22 to vacate a portion of Alcan Street and 120th Street right-of-way in the vicinity of 119th Street and Alcan Street.

Summary:

The following is a request to vacate a portion of the existing street right-of-way for Alcan Street and 120th Street. The applicant is requesting to vacate the sections of right-of-way located along the south property line and a portion of the west property line of the recently approved AdventHealth Medical Office (RZ25-0010).

 

Application VAC-14-002, with Ordinance 14-47, previously approved the vacation of the aforementioned right-of-way on August 5, 2014, following public notification and public hearing. However, the final ordinance inadvertently omitted the required legal description for the subject area to be properly vacated. The purpose of this request is to correct an error in the legal description of the 2014 ordinance.  

 

As part of the Olathe Commons Apartment application (PR-14-003), Alcan Street and 120th Street were realigned. The street right-of-way proposed for vacating is no longer needed and won’t be required for future development.
