Consideration of Second Amendment to Site Lease with T-Mobile USA, Inc.

Summary:
On October 10, 2007, the City of Olathe and T-Mobile USA, Inc. entered into a site lease agreement to install specific telecom equipment on a city-owned tower at 400 E. Harold Street (Street Maintenance Facility).
This agreement was modified by the First Amendment on December 14, 2007.
In late 2024, T-Mobile USA, Inc. requested an updated lease agreement due to a merger with Sprint in 2020 and their desire to consolidate the two networks into one, decommission overlapping cell sites and evaluate terms and conditions of existing agreements and leases throughout the country.
In reworking this agreement with T-Mobile USA, Inc., the City of Olathe took the opportunity to update insurance and relocation provision language within the lease.
This Second Amendment to Site Lease with T-Mobile USA, Inc. will become effective on March 1, 2026, if approved by City Council.

Financial Impact:
Starting March 1, 2026, T-Mobile USA, Inc. agrees to pay the City of Olathe $2,100 per month as rent, increasing by 3% every year, over the term of the lease.
