Summary:
This is a request to accept the dedication of land for public easements for the final plat of Olathe Commons Third Plat located southeast of W. 119th Street and S. Black Bob Road. The plat establishes lot lines and dedicates public easements for two (2) lots and two (2) tracts to accommodate the construction of a one-lot, 214-unit residential development approved with application RZ24-0011 and a future commercial development.
This plat dedicates utility (U/E), public utility (PUB/E), sanitary sewer (SS/E), drainage (D/E), and tree preservation (TP/E) easements. This plat also vacates public easements and other public dedications that were originally dedicated in 2007 for a development that was never constructed and are no longer needed for the new development approved in 2024.
The property is not subject to excise taxes as this is a replat of Olathe Commons First and Second Plats.

Action Needed:

2. Reject the dedication of land for public easements and return the plat to the Planning Commission for further consideration with a statement specifying the basis for the Governing Body’s failure to accept the dedication (majority vote of the Councilmembers present required).
