Summary:
The applicant is requesting a rezoning from the BP (Business Park) District to the R-3 (Low-Density Multifamily) District for a 20-acre property located southwest of College Boulevard and S. Valley Road. The applicant provided conceptual preliminary site development plans and imagery for a three-story multifamily development consisting of nine (9) apartment buildings and six (6) townhome buildings totaling 333 residential units. The project includes a clubhouse, outdoor amenities and trail connections.
The subject property is designated as Mixed Use on the Elevate Olathe Comprehensive Plan Future Land Use Map. In alignment with this designation, the applicant collaborated with application RZ26-0009, Sunnybrook Commercial (also on this meeting agenda), to construct a cohesive residential and commercial development. The mixed-use proposal also aligns with the K-7 Subarea Plan of the Elevate Olathe Comprehensive Plan. In coordination with the commercial application, an overall conceptual master plan shows cross-property connections and shared amenity spaces.
If the rezoning is approved, a revised preliminary site development plan is required prior to development for review of all site, landscaping and architectural requirements of the Unified Development Ordinance.
On August 24, 2026, staff provided an introductory presentation to highlight the uniqueness of the two applications and the new Future Land Use categories of the Elevate Olathe Comprehensive Plan before the scheduled public hearings. The Planning Commission then held a public hearing for the proposed request, and four (4) property owners spoke, raising concerns relating to density, building height, tree preservation, traffic, and compatibility.
Two letters of correspondence were received after the Planning Commission packet was published and are included as Attachment C. Staff also received four (4) phone calls from residents with questions regarding public notification procedures, stormwater, lighting, and traffic, which staff responded to.
The Planning Commission discussed traffic and timing of road improvements, tree preservation adjacent to Meadow Lane Trail, height and line of sight of the proposed buildings, surrounding zoning districts, and clarification of the review process for the revised preliminary site development plans.
After discussion, the Planning Commission voted 6-1 to recommend approval of RZ26-0006 as stipulated.
