Consideration of Ordinance No. 25-23 (RZ25-0004), requesting approval of a zoning amendment to Ordinance 05-25 and Ordinance 01-62 regarding monument signs for the Shops at Sunnybrook and vicinity on approximately 74.30 acres, located southwest of College Boulevard and S. Summary:
The applicant is requesting approval of a zoning amendment to Ordinance 05-25 and Ordinance 01-62 to allow individual monument signage for 16 properties encompassing 74.30 acres of the Sunnybrook development. Ordinances 01-62 and 05-25 both prohibit individual monument signs in favor of major complex signage; however, major complex signs were never pursued by the original developer nor any of the current property owners. Twelve (12) property owners joined this request as they desire the option to install individual monument signs and increase visibility for their business.
Staff is supportive of the request as it will allow individual monument signs on the subject properties as typically permitted by the Unified Development Ordinance (UDO) and it meets PlanOlathe Comprehensive Plan policies including Policy ES-1.4: Support for Local Business. Additionally, the Sunnybrook Shops developed differently than originally planned when individual monument signs were first restricted (Ord. 98-30). The Sunnybrook Shops was originally approved in 1998 as a small commercial development with three (3) lots that all had arterial street frontage, whereas it is now approved for 15 commercial lots, several of which do not have arterial street frontage.
On July 14, 2025, the Planning Commission held a public hearing for the request and no individuals provided public comment. The Planning Commission discussed general questions regarding the types and design of signage that would be allowed if approved. Staff confirmed that major complex or individual monument signs will be allowed on the properties in accordance with the UDO, but major complex signs are unlikely to be pursued due to the number of different owners. After discussion, the Planning Commission voted 9 to 0 to recommend approval of RZ25-0004 as outlined in the staff report.

Action Needed:
1. Approve Ordinance No. 25-23 for a zoning amendment to allow individual monument signs on the subject properties as recommended by the Planning Commission (4 positive votes required).
2. Deny Ordinance No. 25-23 and continue to prohibit individual monument signs on the subject properties (5 positive votes required).
3. Return the zoning amendment application to the Planning Commission for further consideration with a statement specifying the basis for the Governing Body’s failure to approve or disapprove (4 positive votes required).
