Summary:

The applicant is requesting approval to rezone a 5-acre property from the AG (Agricultural) District to the Planned (PD) District with a preliminary site development plan for 133rd and Black Bob Mixed Use. The subject property is located at the southeast corner of W. 133rd Street and Black Bob Road. The preliminary development plan is for a high-quality, mixed-use development that includes 5,280 sq. ft. of commercial and five (5) townhome buildings with a total of 44 dwelling units.

 

Planned Districts (PD) provide flexibility from conventional zoning as they are intended to encourage innovative land planning and design that is not possible under conventional zoning. The applicant is pursuing PD zoning as conventional zoning does not allow for a mix of standalone residential and commercial uses on a single, zoned lot. In accordance with the Unified Development Ordinance (UDO), the applicant has proposed PD zoning & design standards for review, which are included as part of the zoning Ordinance in the agenda packet (Attachment C). If approved, these standards will be the zoning that regulates future development of the subject property.

 

Staff worked closely with the applicant to ensure these standards align with the Comprehensive Plan (Elevate Olathe). Elevate Olathe designates the future land use of this property as Community Commercial and the proposed PD standards require a minimum amount of commercial building area. Additionally, the proposal will bring a mix of residential and neighborhood commercial uses to Olathe, including townhomes, which are a type of missing middle housing encouraged by Elevate Olathe. Lastly, the proposed PD building design requirements exceed typical building design standards, ensuring higher-quality architecture for this project.

 

On July 13, 2026, the Planning Commission held a public hearing for the proposed request, and one (1) resident spoke at the hearing with feedback on traffic improvements. The Planning Commission discussed future traffic improvements as the area continues to develop and voted 6-0 to recommend approval of RZ26-0005 as stipulated by staff with one (1) amended stipulation regarding phasing of the development plan as presented by staff and captured in the Planning Commission minutes. The Planning Commission packet and minutes from this meeting are included as Attachments A & B.
