Summary:

The applicant is requesting a rezoning from the BP (Business Park) District to the C-2 (Community Center) District for an 11-acre property located southwest of College Boulevard and S. Valley Road. The applicant provided a conceptual preliminary site development plan for a bank, general office/retail, fast food, and a sit-down restaurant as complementary commercial uses to the previously approved Dillons Grocery store to the east (RZ25-0020).

 

The subject property is designated as Mixed Use and Vertical Mixed-Use Overlay on the Elevate Olathe Comprehensive Plan Future Land Use Map. Staff worked with the applicant to understand the market feasibility of a vertically mixed- use product along College Boulevard in alignment with Elevate Olathe. The applicant is not proposing a vertical mixed-use development at this time but will further refine plans to retain elements of building placement and pedestrian-oriented development as envisioned by Elevate Olathe.

 

As this area is identified for a mix of uses, the applicant collaborated with application RZ26-0006, Sunnybrook Multifamily (also on this meeting agenda), to construct a cohesive residential and commercial development. In coordination with the residential application, an overall conceptual master plan shows cross-property connections and shared amenity spaces, which aligns with the K-7 Subarea Plan of the Elevate Olathe Comprehensive Plan.

 

Conceptual elevations and a site plan were provided; however, if the rezoning is approved, a revised preliminary site development plan is required prior to development to review detailed site, landscaping, and building elevations against the Unified Development Ordinance (UDO) requirements.

 

On August 24, 2026, staff provided an introductory presentation to highlight the uniqueness of the two applications and the new Future Land Use categories of the Elevate Olathe Comprehensive Plan before the scheduled public hearings. The Planning Commission held a public hearing for the proposed request with no individuals appearing to speak or provide comment, and the applicant provided a brief presentation. Commissioners asked questions regarding the land use differences between the proposed C-2 and existing BP District and the construction timing.

 

The Planning Commission voted 7-0 to recommend approval of RZ26-0009 as stipulated.
