Consideration of Ordinance No. 25-06 (VAC24-0001), requesting approval to vacate a public utility easement; located at 12675 S. Shady Bend Road. Planning Commission recommends approval 7 to 0.

Summary:

This is a request to vacate a public drainage easement at 12675 S. Shady Bend Road. The easement was dedicated with the Cedar Ridge plat in 2019 and later annexed into the City (ANX19-0004) in 2020. The vacation will accommodate the construction of a single-family home, and a new drainage easement will be relocated and constructed by the property owners.

 

The Planning Commission held a public hearing on February 10th, 2024, and no individuals spoke during the meeting. Staff recommends approval and the Planning Commission voted 7-0 to recommend approval as reflected in the meeting minutes.

Action Needed:

1.                     Approve Ordinance No. 25-06 for vacation of a public easement as recommended by the Planning Commission (4 positive votes required).

 

2.                     Deny Ordinance No 25-06 for vacation of a public easement (5 positive votes required).

 

3.                     Reject the vacation of a public easement and return to the Planning Commission for further consideration, advising the Commission of the reasons for the rejection (4 positive votes required).
