Summary:
The national opioid settlements are the result of nationwide litigation and negotiated agreements involving opioid manufacturers, distributors, and related entities. These settlements are intended to resolve governmental claims arising from the opioid epidemic and to provide funding to participating states and local governments for approved opioid remediation purposes, including efforts related to treatment, prevention, and recovery.
National opioid remnant defendant settlement agreements continue to be administered, and additional participation opportunities remain available to eligible local governments. The proposed resolution (Attachment A) would authorize the City of Olathe to become a participating subdivision In Re National Prescription Opiate Litigation, MDL No. 2804, involving 6 remnant defendant companies [(1) Associated Pharmacies, Inc. (and American Associated Pharmacies), (2) J M Smith Corporation, (3) Morris and Dickson Co., L.L.C., (4) Louisiana Wholesale Drug Company, Inc., (5) North Carolina Mutual Wholesale Drug Company, Inc., and (6) United Natural Foods, Inc. (and SuperValu)] by signing the Combined Subdivision Participation and Release Form (Attachment B).
As a participating subdivision, the City would release all released claims against all 6 defendants as provided in the Release Form. The City would also agree to use any settlement funds it receives only for purposes that qualify as opioid remediation under the settlement agreement. The Resolution further authorizes the Mayor, City Manager, City Attorney, and City Clerk to execute and deliver the Release Form and such other instruments as may be necessary.

Financial Information:
Olathe would be entitled to 0.0146340477% of the national settlement allocation. The exact amount the City may receive is not known at this time, but will likely be less than $25,000.
