Consideration of Amendment No.1 to the agreement with Newkirk-Novak Construction Partners, Inc. for construction services for the Modernization of Fire Stations project, PN 6-C-031-24.

Summary:

On May 7, 2024, the City Council approved the construction management agreement with Newkirk-Novak Construction Partners, Inc. (Newkirk Novak) for the Modernization of Fire Stations project to target interior renovations and building expansion needed at Fire Station No. 2.  Initial approval of the agreement authorized Newkirk Novak to provide pre-construction services including bidding of the project.

 

Final design plans and project specifications were issued to Newkirk Novak in May.  After reviewing the construction documents and receiving bids for the specified scopes of work, Newkirk Novak has submitted a cost proposal of $1,641,411 for all work required to complete the project.  Newkirk Novak’s cost proposal is the total cost of the work in the final bid packages.  An additional $125,000 is added as an Owner’s allowance to Newkirk Novak’s cost proposal, which funds are to be used solely by the City to manage unexpected costs which may arise during construction and which the City may be responsible, or to manage scope modifications directed by the City.  The total Guaranteed Maximum Price for the construction of the project, inclusive of the Owner’s allowance, is now established at $1,766,411.

 

Attachment Exhibit C is Amendment No. 1 to the Agreement with Newkirk Novak detailing Newkirk Novak’s GMP proposal.  This Amendment identifies the Guaranteed Maximum Price, the anticipated construction schedule, and the substantial completion date.  This amendment also identifies costs of various bid alternates and allowances.  Approval of this Amendment No. 1 will authorize Newkirk Novak to proceed with construction of the project.  Newkirk Novak is responsible to complete construction of the project as designed within the total Guaranteed Maximum Price unless approved otherwise by the City.  If the project is completed under the guaranteed maximum price, all savings are returned to the City.  Additionally, any unspent funds in the Owner’s allowance are returned to the City.  This Amendment stipulates Newkirk Novak shall achieve substantial completion of construction on or before February 15, 2025.

Financial Impact:

Funding for the Modernization of Fire Stations project, as approved in the 2024-2028 Capital Improvement Plan, is $2,073,143 of General Obligation Bonds.
