Public hearing and consideration of Ordinance No. 24-51 regarding a substantial change to an existing redevelopment district plan and the adoption of a redevelopment project plan pursuant to K.S.A. 12-1770 et seq. (Olathe Gateway Project).

Summary:
On November 28, 2006, the City Council approved Ordinance No. 06-124, adopting the Olathe Gateway TIF Project Area 1 Project Plan for certain areas within the Olathe Gateway TIF District east of Renner Boulevard, south of 119th Street. The TIF District was expanded in 2007 to include certain areas west of Renner Boulevard and south of 119th Street, and again expanded in 2022 to include the area on the northeast corner of 119th and Renner. At present, there are six different project areas identified within the Olathe Gateway TIF District (Areas 1, 2a, 2b, 3, 4, and 5); only Area 1 is currently subject to a Project Plan.
On September 17, 2024, the City Council adopted Ordinance No. 24-35 establishing a STAR Bond Project District and approving a STAR Bond Project District Plan. The STAR Bond District was created to promote, stimulate and develop the general and economic welfare of the state of Kansas and the City, including an ultra-accessible amusement park and a multi-sport arena, as well as new commercial retail uses.
In conjunction with the proposed STAR Bond project for Olathe Gateway, the Olathe Gateway TIF Project Area 2 is proposed as a consolidation of the Olathe Gateway TIF Project Areas 2a, 2b, 3 and 4 (all south of 119th Street, both east and west of Renner Boulevard) into a single project plan. Olathe Gateway Project Area 5 would remain as a separate future Project Plan area within the Olathe Gateway TIF District.
On October 14, 2024, the Planning Commission made a finding that the Project Plan for TIF Project Area 2 (Attachment A) is consistent with the intent of the City’s Comprehensive Plan. This action was required prior to the City Council setting the date and time of a public hearing to consider adoption of the proposed Project Area 2 Project Plan.
On October 15, 2024, the City Council adopted Resolution No. 24-1055 providing for notice of tonight’s public hearing to consider approving a “substantial change” to the Olathe Gateway TIF District Plan and adoption of the TIF Area 2 Project Plan. The proposed District Plan is as follows:
Project Area 1: The buildings and facilities to be constructed or improved in Project Area 1 may be described in a general manner as a commercial development consisting of retail buildings totaling approximately 150,000 square feet and associated public and private infrastructure.
Project Area 2: The buildings and facilities to be constructed or improved in Project Area 2 may be described in a general manner as a mixed-use development consisting of some or all of the following uses: a multi-sport athletic complex for both professional and youth sports uses and events, entertainment uses, including an amusement park, retail uses, restaurant uses, and other general commercial development; hotel uses; residential uses, including multi-family residential facilities; visitor amenities and accessibility improvements and amenities for disabled visitors; and associated public and private infrastructure.
Project Area 5: The buildings and facilities to be constructed or improved in Project Area 5 may be described in a general manner as a mixed-use development consisting of some or all of the following uses: retail, office, residential, industrial, business park/distribution facilities, hotel, conference facilities, museum/entertainment facilities, exhibition facilities, and associated public and private infrastructure.
The ordinance (Attachment B) approves the substantial change to the District Plan as described above and adopts the Project Plan for TIF Project Area 2.
Also on tonight’s agenda, the Governing Body will conduct public hearings to consider creation of a Community Improvement District (CID) and adoption of the STAR Bond Project Plan for the Olathe Gateway project.

Financial Impact:
The estimated total project cost is $320,376,310, of which $23,351,538 of eligible project costs may be reimbursed from TIF proceeds.
