Consideration of Ordinance No. 24-31 (ANX24-0004) requesting approval to annex approximately 12.11 acres, located southwest of W. 159th Street and S. Mur-Len Road, into the corporate boundaries of the City of Olathe.

Summary:

In accordance with K.S.A. 12-520(a)(7), Kim and Cheryree Eldred (the “Petitioners”) have submitted a petition for annexation of approximately 12.11 acres of land (Exhibit A) located southwest of W. 159th Street and S. Mur-Len Road (ANX24-0004), which lies contiguous with the corporate boundaries of the City of Olathe. The property is within the City of Olathe’s Growth Area and is designated on the Future Land Use Map of the Comprehensive Plan as Community Commercial Center and Mixed Density Residential.

The petitioners are pursuing annexation as they wish to sell the property to be developed by separate applicants, and annexation is required prior to zoning. The annexation would eliminate a portion of an enclave which is an unincorporated area completely surrounded by property already within the City.

This annexation request was on the August 6th City Council agenda as a report item.

Financial Impact:

Future development of the property will result in an increase in the City’s real property tax collections.

Action Needed:

Approve Ordinance No. 24-31 (ANX24-0004) annexing approximately 12.11 acres into the corporate boundaries of the City of Olathe.
