Summary:
In accordance with K.S.A. 12-520(a)(7), Susan M. Mackey with 167th Street Properties, LLC (the “Petitioner”) has submitted an annexation agreement (the “Agreement”), a petition for annexation, and a fire district detachment petition for approximately 37.56+/- acres of land located at the southwest corner of 167th Street and Lone Elm Road (ANX25-0003) (Attachment A). The property lies contiguous with the corporate boundaries of the City of Olathe. The property is within the City of Olathe’s Growth Area and is designated on the Future Land Use Map of the Comprehensive Plan as an Employment Area.
The Petitioner is pursuing annexation as they desire to rezone and develop the property for commercial development purposes (consistent with the Annexation Agreement on tonight’s agenda previously), and annexation is required prior to rezoning.
The Ordinance (Attachment B) effectuates the annexation of the property into Olathe, effective upon publication.

Financial Impact:
Future development of the property will result in an increase in the City’s real property tax collections.
