Summary:

Earlier this year, the Kansas Legislature passed HB 2481, which allows (but does not require) cities to adopt an ordinance temporarily expanding the allowable hours for the sale of alcoholic liquor and cereal malt beverage (CMB) to 23 hours per day (excluding the hour between 5 a.m. and 6 a.m.) for the duration of the 2026 FIFA World Cup (June 11 through July 19). The expanded hours would apply both to retail sales in the original packaging or for on-premises consumption. All other laws and regulations regarding the sale of sale of alcoholic liquor and CMB would remain in full force and effect. Individual properly-licensed businesses may still determine their own hours of operation within the expanded allowable hours.

 

Based on feedback from Olathe businesses that some would expand their hours of operation if the allowable hours were expanded, Staff has prepared a proposed ordinance (Attachment A) that would expand the sales hours as allowed by HB 2481. In accordance with the state law, the ordinance would automatically expire on July 20, 2026, and the current allowable hours for sales would then resume. Copies of HB 2481 (Attachment B) and the conference committee report brief, including summary (Attachment C), are also attached.
