Summary:
The applicant requests approval of a rezoning with a preliminary plat and is requesting acceptance of the dedication of land for public easements and public street right-of-way for a final plat of Lakeview Ridge, Third Plat (FP25-00-31). The development contains 15 lots and two (2) tracts on approximately 7.94 acres located northwest of W. 143rd Street and S. Lakeshore Drive. The request includes rezoning the property from CTY RUR (County Rural) District to R-1 (Single-Family Residential) District to allow for detached single-family development.
The property was recently annexed into the City (ANX25-0001) to allow for its development as a single-family subdivision, continuing the pattern and character of the adjacent Lakeshore Meadows and Lakeview Ridge neighborhoods.
The plat (FP25-0031) will dedicate new utility (U/E), sanitary sewer (S/E), and drainage (D/E) easements for fifteen (15) residential lots and four (4) tracts which are designated for amenities, stormwater BMPs, tree preservation, and open space. Right-of-way dedication is also included with this plat for the extension of Red Bird Street and for W. 140th Terrace, which will facilitate future roadway connectivity to the west. This unplatted area is subject to street excise tax of $0.215 per square foot of land and a traffic signal excise tax of $0.0037 per square foot of land area.
The public hearing was held on October 27, 2025, with no public speakers. The Planning Commission voted 9-0 to recommend approval of RZ25-0012 with no stipulations and approved FP25-0031 with no stipulations.

Action Needed:
1. Approve Ordinance No. 25-49 for a rezoning to the R-1 District as recommended by the Planning Commission (4 positive votes required) and accept the dedication of land for public easements for the final plat of Olathe Industrial Tracts, Third Plat (FP25-0031) (majority vote of the Councilmembers present required).
2. Deny Ordinance No. 25-49 for a rezoning to the R-1 District (5 positive votes required) and or reject the dedication of land for public easements and return the plat to the Planning Commission for further consideration with a statement specifying the basis for the Governing Body’s failure to accept the dedication (majority vote of the Councilmembers present required).
3. Return the rezoning application to the Planning Commission for further consideration with a statement specifying the basis for the Governing Body’s failure to approve or disapprove (4 positive votes required).
