Summary:

The City is requesting approval to rezone a 95.6-acre property from the CTY AG (County Agricultural) District to the AG (Agricultural) District and a preliminary site development plan for Olathe Range, located northwest of W. 167th Street and I-35.

 

The development will serve as a public safety training facility for the Olathe Police Department. The initial phase of this project includes two (2) small training facility buildings, under 3,000 square feet each, and a protected outdoor shooting range. Future phases include an approximately 21,000 square foot training facility and an emergency vehicle driver training course. Nearly all existing woodland areas and stream corridors will be retained in their natural state.

 

There are only ten (10) unincorporated County residences within 1,000 feet of the property to the west. A quarry and the railroad are to the northwest and farm fields and I-35 are on all other sides of the property. A noise study was prepared by Avant Acoustics and found that the outdoor shooting range will comply with the City’s Noise Ordinance.

 

The Future Land Use Map of the Comprehensive Plan identifies the subject property as Employment Area and Primary/Secondary Greenway. The requested zoning district and development aligns with the Comprehensive Plan and the standards of the Golden Criteria as outlined in the staff report presented to the Planning Commission. Rezoning to a City zoning district is required prior to development.

 

On April 14, 2025, the Planning Commission held a public hearing for the proposed request with no individuals appearing to speak or provide comment. The Planning Commission discussed general questions regarding the operations of the facility, the noise study and the floodplain on the property. After discussion with City staff, the Planning Commission voted 9 to 0 to recommend approval of RZ25-0002 with the stipulations as outlined in the staff report.

Action Needed:

1.                     Approve Ordinance No. 25-12 for a rezoning from the CTY AG (County Agricultural) District to the AG (Agricultural) District as recommended by the Planning Commission (4 positive votes required).

2.                     Deny Ordinance No. 25-12 for a rezoning from the CTY AG (County Agricultural) District to the AG (Agricultural) District (5 positive votes required).

3.                     Return the rezoning application to the Planning Commission for further consideration with a statement specifying the basis for the Governing Body’s failure to approve or disapprove (4 positive votes required).
