Summary:

The applicant is requesting a rezoning from the CTY RUR (County Rural) District to the R-3 (Residential Low Density Multifamily) District with a preliminary site development plan for Forest View Townhomes. The 12-acre subject property is located southwest of K-7 Highway and W. 119th Street.

 

The proposed development includes 14 two-story multifamily townhome buildings containing a total of 72 two-story dwelling units. Associated site amenities include a covered picnic area, walking trails with seating areas, and recreational sports stations. The plan also incorporates approximately seven (7) acres of open space, including more than three (3) acres of preserved natural areas and tree canopy.

 

The proposal meets UDO requirements for architecture, open space and tree preservation, aligns with several policies of the Elevate Olathe Comprehensive Plan and meets the UDO Golden Criteria for considering rezonings as outlined the Planning Commission Packet (Attachment A).

 

On April 27, 2026, the Planning Commission held a public hearing for the proposed request and five (5) individuals spoke primarily with feedback on tree preservation and traffic impacts in this area.  During the meeting, the Planning Commission discussed traffic improvements along 119th Street, roadway access, parking within the development and the preservation of trees. The Planning Commission voted 8 to 0 to recommend approval of RZ26-0004 as stipulated by staff.
