Summary:

The applicant is requesting a rezoning from the C-2 (Community Center), CTY RUR (County Rural), R-1 (Single Family), and RP-1 (Planned Single Family) Districts to the CC (Cedar Creek) District. The 62.5-acre subject property is located south of College Boulevard and west of Cedar Creek Parkway. There is no preliminary development plan associated with this rezoning request and no specific land uses are identified by the developer at this time.

 

The property is located within the Cedar Creek Overlay District, which was established in August 2012 through the Cedar Creek Area Plan (CCAP). Properties within this overlay area may request a rezoning to the CC (Cedar Creek) District, and as provided by the applicant, the CC District is being requested for its consistency with the PlanOlathe Comprehensive Plan and the flexibility provided through the process outlined in the CCAP. 

 

The subject property is located within the Mixed-Use Subdistrict which allows for a thoughtfully designed mix of both commercial and residential uses. At the intersection of College Boulevard and Cedar Creek Parkway, a Town Center area is designated on the CCAP Land Use Map. However, as permitted through the CCAP, there is no preliminary development plan associated with this rezoning request. Any future preliminary site development plan(s) follow the typical development review process.

 

On January 12, 2026, the Planning Commission held a public hearing for the proposed request, and no property owners spoke at the hearing. Four letters of correspondence were received after the Planning Commission packet was published (Attachment C).

 

The Planning Commission discussed improvements to College Boulevard, the permitted land uses with the CC District, and the benefits of zoning to the CC District. After discussion, the Planning Commission voted 7-1 to recommend approval of RZ25-0017 with no stipulations.

Action Needed:

1.                     Approve Ordinance No. 26-07 for a rezoning to the CC District as recommended by the Planning Commission (4 positive votes required).

2.                     Deny Ordinance No. 26-07 for a rezoning to the CC District (5 positive votes required).

3.                     Return the application to the Planning Commission for further consideration with a statement specifying the basis for the Governing Body’s failure to approve or disapprove (4 positive votes required).
