Summary:

This is a request for approval of a rezoning from the CP-2 (Planned General Business) District to the R-4 (Residential Medium-Density Multifamily) District for the Salvation Army Family Lodge Expansion on approximately 0.21 acres, located northeast of Santa Fe Street and Woodland Road. This request would revert a small portion of the overall Salvation Army property to residential zoning, as the site was rezoned to the CP-2 District in 2010 for the Salvation Army Chapel Addition project.

 

The Salvation Army is pursuing this rezoning to expand the existing family lodge, which is classified as a homeless shelter. This land use is not permitted in the CP-2 District, but is allowed with special use approval in the R-4 District. A separate agenda item requesting special use approval with the proposed preliminary development plan (SU25-0002) is included in the agenda packet.

 

The site is designated as City Center District and Urban Center / Downtown by the Future Land Use Map of PlanOlathe, which envisions this area as a mixed-use urban area with civic, commercial and residential uses. The R-4 District aligns with this vision as it allows both residential and civic uses that will blend with the surrounding residential and commercial areas. The requested zoning district also meets the Golden Criteria as outlined in the staff report presented to the Planning Commission.

 

Three (3) residents attended the neighborhood meeting held on July 7 and all questions about the general operations of the Salvation Army Family Lodge were answered. On July 28, 2025, the Planning Commission held a public hearing for the proposed request with no individuals appearing to speak or provide comment. The Planning Commission voted 8 to 0 to recommend approval of RZ25-0006 with no stipulations.

Action Needed:

1.                     Approve Ordinance No. 25-27 for a rezoning from CP-2 (Planned General Business) District to R-4 (Residential Medium-Density Multifamily) District as recommended by the Planning Commission (4 positive votes required).

2.                     Deny Ordinance No. 25-27 for a rezoning from the CP-2 (Planned General Business) District to R-4 (Residential Medium-Density Multifamily) District (5 positive votes required).

3.                     Return the rezoning application to the Planning Commission for further consideration with a statement specifying the basis for the Governing Body’s failure to approve or disapprove (4 positive votes required)
