Summary:
In May 2021, the Olathe City Council approved a program that would allow neighborhood homeowners associations (HOA), with responsibility for maintenance of private streets, to contract with the City to include private streets in Street Preservation Program projects. The program allows for City assistance with engineering, project management and construction cost reimbursement up to 25%. In the three years of the program, street improvements have been completed in four neighborhoods (see Attachment A for locations). Improvements have included curb and gutter replacement, sidewalk replacement, installation of ADA compliant sidewalk ramps, full depth pavement repairs, asphalt surface replacement, and micro surface application. Below are the construction expenses for the program to date.

One HOA applied to participate in the 2025 program. City staff coordinated with the Mill Creek Farms HOA to determine the project scope and estimated cost necessary to enter into an agreement. The total construction cost is estimated to be $125,257.00, which would include a city share of $31,314.25. The mill and overlay improvements will be advertised as part of the 2025 Local and Collector Street Mill and Overlay Project - Group B. A map of the current and past project locations is included as Attachment A.

Financial Impact:
The 2025 Olathe Private Street Preservation Program is funded from the City of Olathe’s 2025 Street Preservation Program. Funding for the 2025 Street Preservation Program, as approved in the 2025-2029 Capital Improvement Plan, includes:
CIP Fund (Cash) $ 2,800,000
Street Maintenance Sales Tax $ 18,470,000
Total $ 21,270,000
