Consideration of Amendment No. 1 to the Interlocal Agreement between the City of Olathe and Water District No. 1 of Johnson County, for the enlargement of the water service area.

Summary:

On August 17, 2004, the City of Olathe and Water District No. 1 of Johnson County (WaterOne) entered into an interlocal agreement regarding water service areas associated with the Forest View residential development, allowing the City of Olathe and WaterOne to provide water service to certain areas that technically lay within the other’s service boundaries.  At the time, land to the north of Meadows of Forest View Plat 7 that was within the WaterOne service boundary was considered undevelopable.

In 2017, Woods of Forest View was platted, which included five lots to the north of Meadows of Forest View Plat 7.  Although Woods of Forest View lies within WaterOne’s boundaries, WaterOne has determined these five lots would be better served by the City of Olathe, which already has water distribution mains along Kenton Street that are better positioned to serve the lots than WaterOne’s existing mains.

Amendment No.1 (attached) would amend the 2004 interlocal agreement to allow the City of Olathe to provide water to the five lots. The amendment was presented and approved to the WaterOne Board on October 8, 2024.
