Summary:
The applicant is requesting approval of a rezoning from the CTY IP-2 (County Planned Industrial) District to the M-2 (General Industrial) District, a preliminary site development plan, and the dedication of easements for a final plat (FP25-0026) for Earth Contact Products on approximately 2.25 acres located at 15680 S. Keeler Terrace. The applicant intends to redevelop the site by constructing a new 27,825-square-foot industrial building to accommodate office, manufacturing, storage, and shipping operations. Rezoning to a city zoning district is required prior to development.
The proposed use of flex space (office and warehouse) aligns with the permissible uses within the M-2 District and the rezoning is consistent with the PlanOlathe future land-use designation of Industrial Area. The plat and proposed redevelopment adhere to the applicable UDO standards for lots, building height, setbacks, access, parking, landscaping, screening, and stormwater management. Staff has provided a stipulation that final building elevations will comply with all architectural requirements prior to final site development plan approval.
Neighborhood notification was provided to all property owners within 500 feet, and a neighborhood meeting was held on August 26, 2025, with no attendees. No public comments have been received. A public hearing was held on September 22, 2025, and no individuals spoke during the hearing. The Planning Commission voted 9-0 to recommend approval of RZ25-0011 and approved FP25-0026 as presented in the meeting minutes, subject to staff stipulations.

Action Needed:
1. 2. Deny Ordinance No. 25-40 for a rezoning from the CTY IP-2 (County Planned Industrial) District to the M-2 (General Industrial) District (5 positive votes required) and the deny the acceptance of land for public easements for Keeler Terrace Addition, Second Plat (majority vote of the Councilmembers present required).
3. Return the rezoning application to the Planning Commission for further consideration with a statement specifying the basis for the Governing Body’s failure to approve or disapprove (4 positive votes required).
