Summary:

The City is requesting approval to rezone a 7.44-acre property from the C-3 (Regional Center) and MP-2 (Planned General Industrial) Districts to the C-3 (Regional Center) District and a preliminary site development plan for the Olathe Animal Care Campus, located northwest of E. Santa Fe Street and N. Ridgeview Road.

 

The proposed development includes a 21,600 sq. ft. public animal care facility and two (2) future commercial pad sites. This project will replace the City’s existing animal care facility located southeast of Old 56 Highway and Harrison Street. As end users have not been identified, a conceptual plan for the two (2) pad sites along Santa Fe Street is included with a stipulation that a revised preliminary development plan is required prior to development.

 

The Future Land Use Map of the PlanOlathe Comprehensive Plan identifies the subject property as Commercial Corridor, which envisions this corridor transforming over time into a more walkable area incorporating other types of uses. Staff’s recommendation includes one (1) stipulation that limits certain land uses, helping transform the Santa Fe Corridor as envisioned. As stipulated, rezoning from industrial zoning to the C-3 District aligns with the vision of the Comprehensive Plan and the standards of the Golden Criteria as outlined in the staff report presented to the Planning Commission.

 

Neighborhood notice was provided to all property owners within 500 feet, and a neighborhood meeting was held on July 31, 2025, with two (2) attendees with general questions about project scope. On February 23, 2026, the public hearing for this request was held with no public speakers. The Planning Commission discussion included that outdoor noise from this facility will be buffered by the existing raised railroad retaining wall. The Planning Commission voted 7 to 0 to recommend approval of RZ25-0008 as presented in the meeting minutes, subject to staff stipulations.

Action Needed:

1.                     Approve Ordinance No. 26-12 for a rezoning from the C-3 (Regional Center) and MP-2 (Planned General Industrial) Districts to the C-3 (Regional Center) District as recommended by the Planning Commission (4 positive votes required).

2.                     Deny Ordinance No. 26-12 for a rezoning from the C-3 (Regional Center) and MP-2 (Planned General Industrial) Districts to the C-3 (Regional Center) District (5 positive votes required).

3.                     Return the rezoning application to the Planning Commission for further consideration with a statement specifying the basis for the Governing Body’s failure to approve or disapprove (4 positive votes required).
