Summary:
The applicant is requesting a rezoning from the O (Office) District to the C-1 (Neighborhood Center) District with a preliminary site development plan for an Assisted Living Facility. The approximately 2.74-acre property is located at 16560 Indian Creek Parkway, northeast of N. Mur-Len Road and W. Indian Creek Parkway.
The proposed development includes two (2) one-story buildings for a total of 19,772 square feet and 32 beds for Solomon’s Porch Assisted Living. The lot has remained vacant since it was rezoned in 1987 and is part of the existing Indian Creek Office Park, which has shared access to W. Indian Creek Parkway and N. Mur-Len Road. The proposal exceeds UDO requirements for site and building design and provides 62% open space.
The proposal aligns with several housing policies of the PlanOlathe Comprehensive Plan, Olathe 2040: Future Ready Strategic Plan, Communities for All Ages program, and meets the UDO Golden Criteria as outlined in the Planning Commission Packet. While the subject property is designated as Mixed-Density Residential Neighborhood, the C-1 district allows assisted living and neighborhood-scale commercial uses adjacent to residential areas while maintaining a low-intensity residential character.
On December 22, 2025, the Planning Commission held a public hearing for the proposed request with no individuals appearing to speak and no additional discussion was needed. The Planning Commission voted 8 to 0 to recommend approval of RZ25-0018 as stipulated by staff.
