Summary:
In accordance with K.S.A. 12-520(a)(7), Kevan Fouts with Johnson County Aggregates LLC (“Petitioner”) submitted a petition to annex approximately 70.12 acres of land located southeast of W. 151st Street and Old 56 Highway (Exhibit A). The property lies contiguous with the corporate boundaries of the City of Olathe and is within the City of Olathe’s Growth Area. Annexation of this property will eliminate an enclave of unincorporated land that adjoins the city boundary on four (4) sides.
The petitioner is pursuing annexation as they desire to develop a rock quarry and mine on the property, and annexation is required prior to zoning and development. The northern quarter of the property is designated as Neighborhood Commercial and the remainder of the property is designated as Business Park on the Future Land Use Map of the Comprehensive Plan.

Future development of the property will result in an increase in the City’s real property tax collections.
