Consideration of Ordinance No. 25-51 approving an engineer’s survey  and authorizing the acquisition of land for the Lakeshore Meadows Sanitary Sewer Easement Extension Project, PN 1-C-029-25.

Summary:

Project No. 1-C-029-25 was created to construct an approximately 931 linear foot long 12 inch public sanitary sewer line from the Lakeshore Meadows lift station to the property owned by U.S.D. 233 (the “School District Property”) on the north side of 143rd Street, west of Lakeshore Drive, to the east of the Whitetail subdivision.  The School District Property is anticipated to be developed with an elementary school surrounded by a single-family subdivision, all of which will be rezoned and platted at a later date.

 

A permanent sanitary sewer easement and temporary construction easement needs to be acquired for this project across 1 tract of land.

 

Attachment A is a design plan of the project area.

 

On November 18, 2025, the City Council adopted Resolution No. 25-1094 which authorized an engineering survey of land needed for the project.

 

The ordinance (Attachment B) is the second step of the eminent domain process.  The ordinance approves the survey and authorizes the filing of a petition for eminent domain in the Johnson County, Kansas District Court.

 

Land acquisition negotiations are ongoing.  The project is tentatively scheduled to begin construction in mid-2026.  Staff will continue to negotiate with the property owner to try to reach agreements to acquire the property before using the eminent domain process.

Financial Impact:

U.S.D. 233 has agreed to pay the cost of the condemnation action and the cost to acquire the easements.
