Summary:
In accordance with K.S.A. 12-520(a)(7), an annexation application and agreement with Steven M. Mackey, Trustee of the Steven M. Mackey Revocable Trust Dated April 26, 2002, has been submitted by and through Dan Schulte, Aspen Industrial Land Fund I, LLC, pertaining to the annexation of approximately 80.45+/- acres at the northwest corner of 171st Street and Lone Elm Road. (ANX25-0005) (Attachment A). The property lies contiguous with the corporate boundaries of the City of Olathe. The property is within the City of Olathe’s Growth Area and is designated on the Future Land Use Map of the Comprehensive Plan as an Employment Area.
The Petitioner is pursuing annexation as they desire to rezone and develop the property for commercial development purposes in accordance with the terms set forth in the Agreement.
The Agreement describes that the Petitioner will submit applications for rezoning, preliminary and final development plans, and preliminary and final plats, and any changes that may be needed to the City’s comprehensive plan, to develop the Property as an industrial and logistics business park, which may include commercial, office, manufacturing, warehouse/distribution, and other appropriate uses approved by the City, and for other general commercial or mixed-use purposes, as generally depicted on the concept plan included with the Agreement. The Agreement provides additional details regarding certain required land use approvals, financial incentives, and improvements to 171st Street and Lone Elm Road, along with other standard provisions in annexation agreements the City has entered into with other property owners in recent years.
A fire district detachment petition will be submitted prior to annexation so as to begin the process to remove the property from the boundaries of Johnson County Fire District No. 2 upon the approval of the Board of County Commissioners (acting as the board of the Fire District).

Financial Impact:
Future development of the property will result in an increase in the City’s real property tax collections.

Action Needed:
Accept the report. Unless directed otherwise by the City Council, an ordinance annexing the property and related actions to approve the Annexation Agreement will be placed on the December 2, 2025 City Council agenda for formal consideration.
