Summary:

The applicant is requesting approval of a rezoning to the R-3 (Low-Density Multifamily) District and a revised preliminary site development plan for Olathe Commons, located southwest of W. 119th Street and S. Greenwood Street on approximately 23.15 acres. The majority of the property is already zoned for multifamily uses and this proposal consolidates a mix of zoning districts.

 

The development consists of 214 units built in a single phase, with a density of nine (9) dwelling units per acre. This includes 10 single-family homes with a one-car garage, 50 walk-up single-family homes, 27 two-story townhome buildings, and a clubhouse. This will be a maintenance provided community that includes an outdoor swimming pool, yoga lawn, dog park, and linear park, among other amenities.

 

The proposal meets all UDO requirements except for two (2) requested waivers, both of which staff supports as detailed in the attached Planning Commission packet.  The requested setback reduction for two buildings within the north portion of the property allows for a greater preservation of trees to the south. Additionally, building materials are used to create a cottage/farmhouse aesthetic and added architectural features are provided to exceed UDO requirements, in lieu of the requested reduction in Class A and Class 1 building materials.

 

The subject property is largely designated as Mixed-Density Residential Neighborhood with a portion of the site designated as Neighborhood Commercial Center. The R-3 District directly aligns with the Mixed-Density Residential Neighborhood and the 6-acre property located north of this site adjacent to 119th Street will retain its C-2 District zoning.

 

The public hearing was held on August 26, 2024, and 2 individuals spoke regarding density, traffic, tree preservation, and perimeter buffering. After discussion, the Planning Commission voted 8-0 to recommend approval of RZ24-0011 as stipulated.

Action Needed:

1.                     Approve Ordinance No. 24-40 for a rezoning to the R-3 District as recommended by the Planning Commission (4 positive votes required).

2.                     Deny Ordinance No. 24-40 for a rezoning to the R-3 District (5 positive votes required).

3.                     Return the rezoning application to the Planning Commission for further consideration with a statement specifying the basis for the Governing Body’s failure to approve or disapprove (4 positive votes required).
