Summary:

The applicant is requesting approval of a rezoning to the M-1 (Light Industrial) District and preliminary site development plan for Hope Roots Collective. The property is located at 11515 S. Black Bob Road and is currently developed with one (1) residential structure and two (2) accessory structures. 

 

The proposed use is classified as Office and the subject property is designated as Industrial Area on the PlanOlathe Comprehensive Plan Future Land Use Map. The proposed M-1 District directly aligns with this land use designation and surrounding zoning districts, as well as several policies of the Comprehensive Plan.

 

Hope Roots Collective is proposing to utilize the existing structures and natural features of the site to accommodate business operations. The primary structure will be rented out as office space to wellness professionals and each practitioner will have access to the outdoor seating and walking path amenities. The applicant intends to make updates to the barn and garage accessory structures at a later date. Future plans for those structures include a small conference space and therapy cow enclosure. A special animal permit will be required when the therapy cow occupies the site.

 

To ensure compatibility of land uses in the area, and due to adjacent commercial land uses, staff is recommending a list of uses to be restricted on the property as provided in the Ordinance (Attachment C).

 

The public hearing was held on August 12, 2024, and no individuals spoke during the hearing. Staff recommends approval, and following the public hearing, the Planning Commission voted 7-0 to recommend approval of RZ24-0013 as stipulated.

Action Needed:

1.                     Approve Ordinance No. 24-33 for a rezoning to the M-1 District as recommended by the Planning Commission (four positive votes required).

2.                     Deny Ordinance No. 24-33 for a rezoning to the M-1 District (five positive votes required).

3.                     Return the rezoning application to the Planning Commission for further consideration with a statement specifying the basis for the Governing Body’s failure to approve or disapprove (four positive votes required).
