Consideration of Ordinance No. 25-16 amending Chapters 6.06 and 6.09 of the Olathe Municipal Code relating to the abatement of certain nuisances.

Summary:
Each year, the City sends about 3,000 notices of abatements to property owners or tenants to begin the formal abatement process for nuisances on their property. State law allows such notices to be sent by certified mail or to be hand-delivered by staff (“personal service”). However, the Olathe Municipal Code (“O.M.C.”) currently requires the notices to be sent by certified mail.
With postal costs rising, staff has prepared proposed Ordinance 25-16 (Attachment A), which would align the O.M.C. with state law to allow abatement notices to be personally served. The proposed ordinance also would make technical amendments to correct a statutory reference and improve the organization and wording of the amended O.M.C. sections.

Financial Impact:
Staff estimates the City may save about $20,000 annually by using personal service for abatement notices instead of certified mail.
