Consideration of Ordinance No. 19-08 approving an engineer’s survey and authorizing the acquisition of land for the Lakeview Avenue Sanitary Sewer Improvements Project, PN 1-C-024-18 .

Summary:

Project No. 1-C-024-18 was authorized by Resolution No. 17-1093 on December 19, 2017. This project will replace the existing gravity sanitary sewer located between Central Street and Church Street along Lakeview Avenue and between Sunset Drive and Keeler Street along the south side of North Frisco Lake (see Project Location Map - Attachment A).  These mains were identified as overcapacity in the Mill Creek Sanitary Sewer Master Plan and have an increased risk of sanitary sewer overflows or potential backups for residents.  Additionally, this section of sewer main has been in service for over 60 years and is beyond its estimated useful life.

 

Easements need to be acquired on 24 tracts of land for the project and easements on 13 tracts have been acquired to date.

 

On February 5, 2019, the City Council approved Resolution No. 19-1015 which authorized an engineering survey of land needed for the project.

 

This ordinance is the second step of the eminent domain process.  The ordinance approves the survey and authorizes the filing of a petition for eminent domain in the Johnson County, Kansas District Court (Attachment B - Ordinance).

 

To keep the project on schedule, land acquisition needs to be completed by April 30, 2019.  Staff is continuing to negotiate with the property owners to try to reach agreements to acquire the property needed before filing the eminent domain petition.

Funding for the Lakeview Avenue Sanitary Sewer Improvements Project includes:

                     Water & Sewer Fund                     $   258,063

                     Total                     $3,317,800
