Summary:

This is a request to vacate a 15.5’ wide by approximately 480’ long section of sanitary easement located at the Benton House of Olathe at the northwest corner of 151st Street and Blackfoot Drive.  The reason for the vacation is due to the existing sanitary easement being currently located under the building.  A new sanitary easement was dedicated with the final plat (FP17-0008) and the new line is located within the new easement.  The easement to be vacated is no longer necessary. 

 

The site is located within the City of Olathe water and sewer service area. A new sanitary easement was dedicated with the final plat (FP17-0008).  The Department of Public Works has reviewed the vacation request and is recommending approval as shown on the exhibit. 

 

Public notification letter were mailed to surrounding properties within 200 feet per UDO requirements. Staff has not received any concerns regarding the proposed vacation.

 

The Planning Commission held a public hearing on August 12, 2019. The Planning Commission recommended approval of the vacation of the sanitary easement with a vote of 6-0 as shown in the minutes. Nobody spoke in opposition at the public hearing and no protest petitions have been submitted for the vacation.

Action Needed:

1.                     Approve Ordinance No. 19-54 for vacation of a sanitary easement as recommended by the Planning Commission.

2.                     Reject the vacation of a sanitary easement and return to the Planning Commission for further consideration, advising the Commission of the reasons for the rejection.
