Summary:

This is a request to vacate four public utility easements for Garmin Properties located at 1200 E. 151st Street.  The subject easements are no longer needed following relocation of utilities for the warehouse building on the subject property. 

 

The easements to be vacated include a waterline easement, two sanitary sewer easements and part of a drainage easement. The utilities have been relocated and the required easements have been dedicated.  As a result, the subject easements are no longer required. The site is located within the City of Olathe water and sewer service area and the Public Works Department has reviewed the exhibits for easement vacation and recommends approval as proposed.

 

The subject easements are located within the interior of the site, over 200 feet away from any property lines, and there is no effect on public utilities for the surrounding properties.

 

The Planning Commission held a public hearing on July 22, 2019 and no property owners spoke at the hearing. The Planning Commission recommended approval of the easement vacations with a vote of 7-0 as noted in the minutes.

Action Needed:

1.                     Approve Ordinance No. 19-53 for vacation of a waterline easement, sanitary sewer easements and drainage easement as recommended by the Planning Commission.

2.                     Reject the vacation of waterline easement, sanitary sewer easements and drainage easement and return to the Planning Commission for further consideration, advising the Commission of the reasons for the rejection.
