Consideration of a Construction and Maintenance Agreement with BNSF Railway Company to acquire easements for the Church Street Improvements Project, PN 3-R-001-19..

Summary:
This Construction and Maintenance Agreement will provide permanent and temporary easements necessary to improve Church Street, between Loula Street and Park Street. Approximately 300 feet of the existing street is on BNSF property and the City has no existing easements to allow for maintenance. This agreement will allow the City to reconstruct the existing street and maintain the street in the future.
The total cost for easements is $60,400. This cost includes: $58,000 for a permanent easement, $400 for a temporary easement, and $2,000 for an administrative fee. These costs are within the authorized budget for the 2019 Street Reconstruction Program.
The street improvements will include full depth asphalt pavement and subgrade replacement, installation of concrete curb and gutters, installation of new sidewalk, replacement of driveway approaches, streetlight installation, and stormwater improvements. Construction of this project, from Sunset Street to Loula Street, started in July 2019. The project will be completed by the end of the year.

Financial Impact:
This project is funded from the City of Olathe’s 2019 Street Reconstruction Program authorized on September 4, 2018. Authorized revenue for the 2019 Street Reconstruction Program includes:
