Planning Commission recommends approval 9-0 at the Public Hearing held October 28, 2019.

Summary:

This application request is for a rezoning from C-2 (Community Center) to D (Downtown, Core) and a preliminary site development plan for Chestnut North Mixed-Use Building. The subject property is located at the southwest corner of Santa Fe Street and Chestnut Street and accompanies a second mixed-use proposal RZ19-0021. The preliminary site development plan includes a 4-story building with 70 residential units and approximately 1,761 square feet of ground level retail at the corner of Santa Fe and Chestnut Street. The site is currently being used as a public parking lot. 

 

On October 28, 2019 a public hearing was held before the Planning Commission at which time eleven (11) individuals spoke with concerns pertaining to both downtown applications presented (RZ19-0020 and RZ 19-0021). Those meeting minutes are attached and will be discussed in detail with application RZ19-00021. After discussion, the Planning Commission recommended approval by a vote of 9-0. Following the public hearing, a valid protest petition was filed on this location only. 

 

This application was originally submitted on August 23, 2019. Since that time, while proceeding through the zoning process staff has continued conversations with the applicant regarding the site’s highest and best use in anticipation of the market demands resulting from both the new residential development planned by the applicant, and the recent announcement by Lane4 behind Civic Center Park on Santa Fe.

 

As a result of these discussions, the applicant is now requesting a continuance of this zoning case to focus efforts on the Chestnut South location (RZ19-0021). If that case is approved, this application will be withdrawn for the City to focus efforts on redevelopment of this parking area for commercial growth and activity. 

 

No action is needed by the Governing Body for the continuance and subsequent withdrawal of this application. If the associated zoning petition (RZ19-0021) is not approved, the applicant will proceed with this request which, as a result of the protest petition, will require a three-fourths vote of the Governing Body (6 votes) in the affirmative to approve.

Action Needed:

1.                     No action needed if the case is withdrawn

2.                     Approve Ordinance No. 19-76 for a rezoning from the C-2 District to the D (Downtown, Core) District as recommended by the Planning Commission.

3.                     Deny Ordinance No. 19-76 for a rezoning from the C-2 District to the D (Downtown, Core) District.

4.                     Return the rezoning application to the Planning Commission for further consideration with a statement specifying the basis for the Governing Body’s failure to approve or disapprove.
