Consideration of Ordinance No. 20-11 (VAC20-0001), requesting vacation of an existing waterline easement at Prairie Trails West II; located at 14924 S. Black Bob Road. Planning Commission recommends approval 7-0.

Summary:

This is a request to vacate an existing, 15-foot-wide waterline easement at 14924 S. Black Bob Road. Howell Family Dentistry is constructing a building on the property which will be built over the existing waterline. An existing fire hydrant will be relocated to accommodate the construction.

The site is located within the City of Olathe water and sewer service areas, and the vacation has no effect on public or private utilities for the surrounding properties. The Public Works Department has reviewed the vacation request and recommends approval as proposed.

The Planning Commission held a public hearing on April 13, 2020. The Planning Commission recommended approval of the vacation of an existing waterline easement with a vote of 7-0 as reflected in the minutes. No individuals spoke in opposition of the vacation request at the public hearing.

Action Needed:

 

1. Approve Ordinance No. 20-11 for vacation of an existing waterline easement as recommended by Planning Commission.

2. Reject the vacation of an existing waterline easement and return to the Planning Commission for further consideration, advising the Commission of the reasons for the rejection.
