Consideration of Ordinance No. 20-19 approving an engineer’s survey and authorizing the acquisition of land for the I-35 & 119th Street Interchange Improvements Project, PN 3-C-026-16.

Summary:

Project No. 3-C-026-16 was created by Resolution No. 19-1046 on June 18, 2019.

 

The Project will improve the capacity of the interchange and ramps. The Project will modify the layout of the existing bridge over I-35 to accommodate a diverging diamond configuration. The Project also includes widening and other modifications to 119th Street between Renner Road and Strang Line Road. The bridge to the west of I-35 over the BNSF railroad tracks will be widened, multi-modal improvements will be made to accommodate pedestrian traffic, and all other work necessary to complete the Project. 

 

On June 2, 2020 the City Council approved Resolution No. 20-1040 which authorized an engineering survey of land needed for the project. This Ordinance will authorize the acquisition of public street dedications, permanent utility easements, and permanent sewer easements to property on two tracts of land for the project.  The approval to obtain the other ten properties was granted in Ordinance 20-15 on May 5, 2020.

 

This ordinance is the second step of the eminent domain process.  The ordinance approves the survey and authorizes the filing of a petition for eminent domain in the Johnson County, Kansas District Court (Attachment B).

 

To keep the project on schedule, land acquisition needs to be completed by July 31, 2020 to allow the project to be completed by the end of 2021.  Staff is continuing to negotiate with the property owners to try to reach agreements to acquire the property before using the eminent domain process.
